That's actually a very good question.

I've not tested, but I would assume that these 40 bytes are free to use, like the bytes from BFE0 to BFFF :)

I'm trying my best to make/keep the whole DF thing in the way I would like many places to be, with a reasonably good signal/noise ratio, no name calling and community fight, free sharing of information, etc... I admit that sometimes I lose my cool on some topic, but I'm trying :)
